Terms and Conditions

Grand County Internet Services (GCIS) may only be used for lawful purposes.  Transmission of any material in violation of any US or state regulation is prohibited.  This includes but is not limited to: copyrighted material, threatening or obscene material, or material protected by trade secret.  You agree to indemnify and hold harmless GCIS from any claims resulting from your use of the service which damages you or another party.  GCIS is not responsible for the functioning of the customers equipment.

Use of any information obtained via GCIS is at your own risk.  GCIS specifically denies any responsibility for the accuracy or quality of information obtained through its network.  GCIS exercises no control whatsoever over the content of the information residing on or passing through it.

GCIS makes no warranties of any kind, whether expressed or implied, for the service it is providing.  GCIS also disclaims any warranty of merchantability or fitness for any particular purpose.  GCIS will not be responsible for any damages you suffer.  This includes loss of data resulting from delays, non-deliveries, mis-deliveries, or service interruptions caused by it’s own negligence or your errors or omissions.  GCIS will attempt to provide information about outages and other information we feel that is of interest to our subscribers at the following Web Page:   http://status.rkymtnhi.com  We will also attempt to communicate to you ,warning of, and description of  outages.

Use of other organizations networks or computing resources must comply with the rules appropriate for that network.  GCIS services may not be used for unsolicited bulk email services , mail relaying, or “spamming”.

GCIS or other relevant authorities may determine inappropriate usage of this account and the privilege may be revoked at GCIS’s discretion.  Should this occur, you will be informed via your email and in writing.  Any deposits will be subject to forfeiture.

GCIS may occasionally require new registration and account information from you to continue the service.  You will notify GCIS of any changes in your account information.  You will also notify GCIS immediately, if there is a disruption in service over 3 weeks in duration, due to vacation, broken equipment, extended part time residence elsewhere, etc..  Upon notification, we will adjust billing appropriately.

You agree to the rates and billing procedures as set forth in the current version of Grand County Internet Services rate schedule.  GCIS reserves the right to change the rates and otherwise modify this agreement upon 30 days notice to you.  This notice may be via email or posted to our web site.  Use of GCIS after the effective date constitutes acceptance of the new terms and conditions.  Payments must be received prior to usage in any period.  Past due accounts may be disabled until receipt of payment.  Late charges may be billed and restart fees for accounts disabled due to late payment.   You must notify us to cancel your account 30 days prior to the 1st of any month or may you may incur additional charges on your account. Your last month deposit will not be returned but must be applied to last month of service

  1. The wireless equipment(antenna, cable and Radio) and furnished firewall router belongs to GCIS and must be removed by certified GCIS installer. Customer is responsible for wireless equipment and must pay replacement cost if not returned to GCIS in working order.  Customer should protect GCIS equipment from power surges through customers power lines.
  2.  Replacement routers will be billed at $50 and become customer equipment.  If customer has own router, it may be used, if it has remote management and will be setup by  our installer and configured only by GCIS personnel.  This is not recommended.
  3. If the Customer is moving or terminating service they should notify us 30 days in advance so we can arrange for the removal of the equipment and application of last month deposit. Last month deposit will be forfeited if notification is less than 30 days. If the Outside antenna has been painted, it will be considered bought and a fee of $100 must be paid.  The Customer must pay $75 if GCIS equipment is un-installed within 1 year of installation.
  4. GCIS is not responsible for the functioning of the customers equipment, only for the wireless equipment and router furnished by GCIS.  Customer is also responsible for protecting their equipment from viruses, adware, spyware, trojan horses, etc.  
  5. If a wireless network is being used on premises, the network may not be an open network and must be protected by WPA2 and/ or other means to keep unauthorized persons from using the high speed network.  This applies whether or not GCIS equipment is used.  Due to the instability of wireless software/hardware built into computers, GCIS cannot take any responsibility for the proper functioning of customer premises wireless networks or the computers hooking up to them.  Any additional support for them will be billed at $60 per hour.  See our wireless Fair Use Policy online.
  6. GCIS is not liable of any damages due to lightning or power surges. It is the responsibility of the customer to arrange for proper grounding of the premises.   Customer takes responsibility for any damages if grounding is not finished, including damages to GCIS owned hardware.  
  7. Any onsite visits to repair or replace GCIS Antennas and Radios that have failed will not be billed labor charges unless it is related to equipment damage due to lightning, power failures or caused by Customer.  Onsite visits to replace failed  inside equipment such as routers, hubs, or switches  will be billed at $60 per hour including travel time no matter what the cause of failure.  GCIS owned radio related equipment will not be billed  unless the manufacturer rejects the equipment having failed under non-warranty conditions.  In that case, the customer will be billed the replacement equipment cost.  Equipment lost due to lightning, fires, floods, etc. will be charged to customer at replacement cost and should be covered by customer insurance.  Any emergency repairs outside our regular schedule may have additional charges for time and mileage.

The Terms and Conditions reflect the entire agreement of the parties and supersedes all prior oral or written agreements and understandings of the parties.  These terms and conditions shall be governed and interpreted in accordance with the laws of the State of Colorado and the United States of America.These terms and conditions may change from time to time and the current conditions may be found on our services internet pages at:  http://grandcountyinternet.com/terms.html

Rates:

2.5Mbs total bandwidth account - usually 1.5 Mbs down and 1.0Mbs up         $40 / month
5Mbs total bandwidth  account -  usually 3 Mbs down and 2 Mbs  up              $55 / month
8Mbs total bandwidth account  -  usually 6 Mbs down and 2 Mbs up               $80 / month

All bandwidth is equally shared over a current Backbone of 3Gbs. (Voice over IP (VOIP), Secure connections, and other continuous bandwidth applications are not given higher priority unless contracted.  Video Streaming applications such as Netflix are not guaranteed as they can be affected by total usage on the wireless network.  Servers of any type including WebCams and Security systems must be registered with us and may have an extra charge.  File sharing programs such as Bit torrent and other peer to peer programs are not allowed as they can completely cause the wireless network to malfunction and usually involves copyright infringement).  GCIS reserves the right to limit monthly usage and charge for over usage of the network at any future time.

Installation and extra Costs (All Installations are done by outside contractor.)

Standard Installation
The inside install includes one normal wireless router, one Ethernet LAN cable up to 14’ and setting up the PC (software) and verifying the wireless signal from the router.  The outside installation includes the mounting of an outside antenna on a chimney, roof side flashing, or any area that does NOT require use of a custom bracket to mount the outside wireless antenna.  This applies only to single story units.  Total install time is 3 hours.

Installation; (general exception) - $60.00 per hour
Over 3 hours plus any extra custom materials, to run RJ-45 networking cable ($.80 a foot) thru walls, floors, attic, and etc. plus the footage charge for extra cable.  Applies to any extra software or computer work that may be necessary.  Outside this includes any  additional custom bracket, Antenna mast, cable runs, roof mounting, hole digging and cable running in addition to a standard installation  (plus extra equipment costs).

Extreme Outside Installation - $80 per hour for time spent above 1 story.
This installation is reserved for any installations that are 2 stories or more and/or would require the use of special equipment, materials. Any of the above requirements would warrant this type of installation. It would include the standard outside/inside installation of up to 3 hours.

Exceptions - Any install requiring use of extra materials, labor, and or special equipment above the standard installations will have a quote submitted in writing and be signed by the Customer before any installation.  All installations will be scheduled by location in county on a regular basis. Any emergency installations outside our regular schedule may have additional charges for time and mileage.

Maximum install time on a single computer is less than 30 minutes if the computer is functioning properly.  Any extra time spent  during installation due to an improperly configured computer, or to remove viruses, spyware or adware will be billed at $60 per hour.  

Additional onsite visits for computer or network services by outside contractor will be billed directly by the contractor and is not the responsibility of GCIS.
